Terms of Service

1. Acceptance of terms

By accessing or using DUGHUB (“the Service”), you agree to be bound by these Terms of Service. The Service is operated by Gauge Advertising Private Limited (“we”, “us”, or “our”). If you do not agree to these terms, do not use the Service.

2. Eligibility & accounts

You must be at least 18 years old to use the Service. By creating an account, you represent that all information you provide is accurate and that you have the legal capacity to enter into a binding agreement. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at contact@adgen.ai if you suspect unauthorised access.

3. AI-generated content & ownership

You retain full ownership of designs and creative content you produce using the Service, subject to applicable law and the terms of any third-party AI model providers integrated into DUGHUB. We do not claim ownership of your designs. You grant us a limited, non-exclusive licence to store, process, and transmit your content solely to provide and improve the Service.

You are solely responsible for ensuring that your use of AI-generated content complies with applicable laws, including intellectual property law. We make no warranty that AI-generated outputs are original, non-infringing, or fit for any particular purpose.

4. Credits & billing

Certain features of the Service consume AI credits. Credits are a consumable resource; once used they cannot be recovered. Subscription plans and credit top-ups are billed through Razorpay. Prices are displayed at the time of purchase in Indian Rupees (INR) and are subject to applicable taxes.

We reserve the right to change pricing with at least 30 days' advance notice communicated via email or an in-app banner. Continued use of the Service after a price change constitutes acceptance of the new pricing. For our cancellation and refund policy, see the Refund & Cancellation Policy.

5. Prohibited use

You agree not to:

• Use the Service to generate content that is illegal, defamatory, obscene, or violates the rights of others
• Attempt to circumvent credit gates, billing, or any access control mechanism
• Scrape, reverse-engineer, or resell access to any part of the Service or its underlying AI APIs
• Use automated scripts or bots to interact with the Service in a way that exceeds normal human usage
• Upload content that contains malicious code or infringes third-party intellectual property rights

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

6. Disclaimer & limitation of liability

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that AI outputs will be accurate or suitable for your intended use.

To the maximum extent permitted by applicable law, our total liability to you for any claim arising out of or relating to these terms or the Service shall not exceed the amounts paid by you to us in the three months immediately preceding the event giving rise to the claim.

7. Modifications to terms

We may update these terms from time to time. Material changes will be communicated at least 30 days in advance by email or an in-app notice. Your continued use of the Service after the effective date of updated terms constitutes your acceptance of the changes.

8. Governing law

These terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Delhi, India.
